Sexual Assault
 
What is Sexual Assault?
Sexual Assault is a crime. Sexual assault is defined as intentional sexual contact, characterized by use of force, physical threat or abuse of authority or when the victim does not or cannot consent. Sexual assault includes:
 

Sexual Act - Penetration of the vagina with any part of the body except the tongue or with an object.

Sexual Contact - Intentional touching (directly or through the clothing) of the genitalia, anus, groin, breast, inner thigh, or buttocks of another person.

      • Rape - sexual intercourse by force and without consent.
      • Forcible Sodomy - oral or anal sex by force and without consent.
      • Indecent Assault - unwanted, inappropriate sexual contact or fondling.
      • Carnal Knowledge - sexual intercourse with a child under age 16.
Sexual assault can occur without regard to gender or spousal relationship or age of victim.
 
“Consent” shall not mean the failure by the victim to offer physical resistance.  Consent is not given when a person uses force, threat of force, coercion or when the victim is asleep, incapacitated, or unconscious.  Prior consent does NOT imply present consent.

Differences between Sexual Assault and Sexual Harassment

Sexual assault and sexual harassment are not the same, although they are related to each other.

Sexual Harassment:

·   Sexual harassment is a form of gender discrimination that involves unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature.

·  Sexual harassment can involve physical contact; it also refers to verbal or other forms of gender discrimination of a sexual nature.  When physical contact becomes sexual in nature (i.e. grabbing or rubbing the butt or grabbing a breast) it crosses the line into sexual assault.

·  There are two types of sexual harassment:

o       Quid Pro Quo - sexual harassment refers to conditions placed on a person’s career or terms of employment in return for sexual favors. It involves threat of adverse actions if the victim does not submit or promises of favorable action if the person does submit.

o       Hostile Environment - sexual harassment occurs when a person is subjected to offensive, unwanted, and unsolicited comments and behavior of a sexual nature that interferes with that persons work performance or creates an intimidating, hostile or offensive working environment.

Sexual Assault:

·  Sexual assault refers specifically to rape, forcible sodomy, indecent assault, or carnal knowledge, or attempts to commit these acts as defined by the Uniform Code of Military Justice (UCMJ).  (See definitions above)

·  Sexual assault is a crime punishable by the UCMJ.

·  Other sex-related offenses are defined as all other sexual acts or acts in violation of the Uniform Code of Military Justice that do not meet the above definition of sexual assault, or the definition of sexual harassment as promulgated in DoD Directive 1350.2, Department of Defense Military Equal Opportunity. Examples of other sex-related offenses could include indecent acts with another and adultery.

What are the Reporting Options for Military Members?

Restricted Reporting

  • This option is recommended for victims of sexual assault who wish to confidentially disclose the crime and receive medical treatment and counseling without triggering the official investigative process. Service members who are sexually assaulted and desire restricted reporting under this policy must report the assault to specifically identified individuals to include the Sexual Assault Response Coordinator (SARC), Victim Advocate (VA), a healthcare provider or chaplain. This policy on restricted reporting is in addition to the current protections afforded under the privileged communications with a chaplain, and does not alter or affect those protections.   
  • Healthcare providers will initiate the appropriate care and treatment, and report the sexual assault to the SARC in lieu of reporting the assault to law enforcement or the command. Upon notification of a reported sexual assault, the SARC will immediately assign a VA to the victim. The assigned VA will provide accurate information on the process of restricted and unrestricted reporting.   
  • At the victim’s discretion/request, an appropriately trained healthcare provider shall conduct a sexual assault forensic examination (SAFE), which may include the collection of evidence. 

 

Unrestricted Reporting  

  • This option is recommended for victims of sexual assault who desire medical treatment, counseling and an official investigation of the crime. When selecting unrestricted reporting, a victim should use current reporting channels (e.g. chain of command, law enforcement), report the incident to the Sexual Assault Response Coordinator (SARC), or request their healthcare provider to notify law enforcement. Upon notification of a reported sexual assault, the SARC will immediately assign a Victim Advocate (VA).  At the victim’s discretion/request, the healthcare provider shall conduct a sexual assault forensic examination (SAFE), which may include the collection of evidence. Details regarding the incident will be limited to only those personnel who have a legitimate need to know.

 

 
What options do I have if I am sexually assaulted?
      • Find a safe environment - anywhere away from the offender. Ask a trusted friend to stay with you for moral support.
      • Call 911 if you need immediate medical or police assistance.
      • Preserve all evidence of the assault:  avoid drinking, bathing, showering, urinating, douching, brushing your teeth, or changing your clothes.  Try to write down everything you can remember about the assault and the offender.
      • Go to the nearest emergency room (ER) to be examined for any injuries and screened for possible sexually transmitted diseases or pregnancy.
      • Report the crime.  Reporting the crime can help you regain a sense of personal power and control and can also help to ensure the safety of other potential victims.

Role of Victim Advocate
 

The Installation Victim Advocate provides victims of sexual assault a resource for immediate and ongoing information and referral assistance, safety planning, and support services.

The Installation Victim Advocate will:

  • Respond to the referral for the victim of sexual assault.
  • Ensure that the victim understands that talking to the victim advocate is voluntary.
  • Assist the victim in clarifying choices regarding medical exams, treatment, and the investigative process, and interacting with his/her command and additional support personnel they may wish to see.
  • Inform the victim of reporting options and have them sign a victim preference statement.
  •  Ensure the victim receives guidance and emotional support.
  •  Assist the victim in regaining control of their environment.
  •  Explain what medical procedures will occur.
  •  Ensure the victim knows he/she is in control and can say “yes” or “no” at anytime to the procedures.

·         Offer victim information, as appropriate, regarding local resources for immediate safety and long-term protection and support, workplace safety, housing, child care, legal services, clinical resources, medical services, chaplain resources and other military and civilian support services.

·         Provide basic techniques of crisis intervention, reinforcement of explanations, and information for emotional, medical, and legal follow-up, as well as a “presence” during legal and judicial procedures.

Command Measures for Protecting the Victim
  • Commanders should determine the best course of action for separating victims from the offenders during the investigation of sexual assault cases.   If the victim and offender are in the same unit, command can separate them to include transfer of one or the other to a different unit and/or installation.        
  •  Commanders may issue a Military Protection Order (MPO) or no-contact order.   These orders are valid both on and off-post with violations being punishable under the UCMJ.  While both oral and written no-contact orders can be given, it is recommended that Commanders put them in writing.  Written documentation of an MPO should be put on form DA 2873 and a   copy must be provided to the victim within 24 hours. 
  • Commanders should also collaborate with the Installation Victim Advocate  and Social Work Services to ensure safety planning is provided for the victim.
